By purchasing, registering for, or using Leadsback, the customer agrees to these Terms and Conditions.
1. Who we are
Leadsback (“we,” “us,” “our”) is a form and cart abandonment recovery service, providing a WordPress plugin and dashboard.
Company: Leadsback
Address: Simon Stevinweg 27, 6827 BS, Arnhem, Netherlands
Chamber of Commerce (KVK): 75484269
VAT number: NL002396665B75
Contact: contact@leadsback.app
2. Definitions
- Service: the Leadsback plugin, dashboard, and related services.
- Customer: the website owner or business that registers for and uses the Service.
- End user: a visitor to the customer’s website whose partial form or checkout data is captured through the Service.
- Agreement: the contract formed between Leadsback and the customer, consisting of these Terms, the applicable order or plan, and our Privacy Policy.
3. Applicability
These Terms apply to every offer, order, and agreement between Leadsback and a customer, unless we’ve agreed otherwise in writing. Leadsback is offered to businesses and professionals acting in the course of a trade, profession, or business, not to consumers acting in a private capacity. Any purchase or general terms used by the customer are expressly rejected, unless accepted by us in writing.
4. The Service
Leadsback provides a plugin that customers install on their own WordPress website, together with a dashboard for viewing and managing partial form entries and abandoned checkouts. The Service works with WordPress, WooCommerce, and supported third-party form and marketing tools.
Leadsback acts as a data processor for end user data captured through the plugin. The customer is the data controller for that data and is responsible for having a lawful basis to collect it, including any required consent, as set out in our Privacy Policy.
5. Account registration
To use the Service, the customer creates an account and provides accurate name, email, billing, and website details. The customer is responsible for keeping login credentials confidential and for all activity under their account. Leadsback should be notified without delay of any unauthorized use.
6. Free trial
We offer a free 14 day trial, without payment required, so customers can test the dashboard and recovery features before committing to a paid plan. At the end of the trial, a paid plan must be selected to continue using the Service. Leadsback may change or discontinue the trial offer at any time.
7. Plans and pricing
Leadsback offers the following plans, billed monthly or yearly (two months free on yearly billing):
| Plan | Price | Includes |
|---|---|---|
| Business | €59/month | Up to 3 projects, dashboard, recovered revenue overview, email and in-app notifications |
| Marketing | €149/month | Up to 10 projects, dashboard, recovered revenue overview, email and in-app notifications |
| Agency | €299/month | Up to 25 projects, dashboard, recovered revenue overview, email and in-app notifications, priority support |
Prices are in euros and exclude VAT unless stated otherwise. We may change prices for future billing periods, with notice sent to the customer’s registered email at least 30 days in advance. Continued use of the Service after a price change takes effect counts as acceptance.
8. Payment
Payments are processed through our payment partner (currently Mollie). Subscriptions renew automatically each billing period unless cancelled before the renewal date. If a payment fails, we may suspend access to the Service until payment is received. The customer is responsible for keeping billing details current.
9. Right of withdrawal
Leadsback is provided to businesses and professionals, not to consumers. The statutory 14 day right of withdrawal for consumers under Dutch and EU law (implementing the Consumer Rights Directive 2011/83/EU) therefore does not apply to these Agreements.
Where a customer purchases as a natural person acting outside a trade or profession, and EU consumer law does apply, the customer has a 14 day right to withdraw from the Agreement without giving reasons, starting on the day the Agreement is concluded. Because the Service is a digital service that starts running immediately, this right ends earlier if the customer expressly requests immediate access and confirms they lose their withdrawal right by doing so. Where the right applies, withdrawal can be exercised by emailing contact@leadsback.app.
10. Money-back guarantee
Independent of the above, we offer a 30 day money-back guarantee on paid plans. If a customer isn’t satisfied within 30 days of their first payment, they can request a refund by contacting contact@leadsback.app. Refunds under this guarantee are issued to the original payment method within a reasonable time after approval.
11. Term and termination
Subscriptions run for the billing period selected (monthly or yearly) and renew automatically unless cancelled by the customer before the renewal date, through the dashboard or by contacting us. Leadsback may suspend or terminate access if the customer breaches these Terms, fails to pay, or uses the Service unlawfully. On termination, access to the dashboard ends; data retention after termination is handled as described in our Privacy Policy.
12. Data protection
Personal data is processed as described in our Privacy Policy. Where Leadsback processes end user personal data on the customer’s behalf, the customer acts as controller and Leadsback as processor, in line with Article 28 GDPR. Customers who need a separate Data Processing Agreement can request one at contact@leadsback.app.
13. Intellectual property
All intellectual property rights in the Service, including the plugin, dashboard, software, and documentation, belong to Leadsback or its licensors. Customers receive a non-exclusive, non-transferable right to use the Service for their own business during the term of the Agreement. Nothing in these Terms transfers ownership of any intellectual property to the customer.
14. Availability and support
We aim to keep the Service available and performing reliably, but we don’t guarantee uninterrupted or error-free operation. Planned maintenance, third-party outages, or technical issues may cause temporary unavailability. Support is provided by email, with response times and scope varying by plan.
15. Liability
To the extent permitted by Dutch law, Leadsback’s total liability under the Agreement is limited to the amount paid by the customer for the Service in the 12 months preceding the event giving rise to the claim. We aren’t liable for indirect damage, including lost profit, lost revenue, or lost leads. Nothing in these Terms limits liability for intent, gross negligence, or damage that can’t be limited under mandatory law.
16. Force majeure
Neither party is liable for delay or failure to perform caused by circumstances beyond its reasonable control, including outages of hosting providers, payment processors, or other third-party services the Service depends on.
17. Changes to these terms
We may update these Terms from time to time. We’ll post the updated version on this page with a revised “Last updated” date, and notify customers of material changes by email where required. Continued use of the Service after changes take effect counts as acceptance.
18. Governing law and disputes
These Terms are governed by Dutch law. Disputes that can’t be resolved informally will be submitted to the competent court in the district where Leadsback is established (Gelderland, location Arnhem), unless mandatory law provides otherwise.
19. Contact us
Questions about these Terms can be sent to contact@leadsback.app or through the contact page.
